Booking Terms & Conditions

These Terms & Conditions apply to all bookings with TannerUnderwater Charters LLC and TannerUnderwater LLC (“Tanner Underwater”).

Every guest must also complete a separate Assumption of Risk and Release of Liability before boarding the vessel or participating in any activity.

Booking Requirements

A reservation is confirmed only after Tanner Underwater receives the required payment and issues a booking confirmation.

The person making the reservation is responsible for providing accurate information and communicating these Terms & Conditions to everyone included in the booking.

Each guest must complete the required waiver before boarding. A parent or legal guardian must complete the applicable documents for any minor.

Guest Cancellations and Refunds

Cancellations made at least 48 hours before the scheduled departure may be eligible for a refund or rescheduling, subject to the terms provided at booking.

The following are nonrefundable:

  • Cancellations made within 48 hours of departure

  • No-shows

  • Guests who arrive more than 15 minutes late

  • Trips that have already departed or been completed

  • Voluntary decisions not to participate after arrival

Refunds, credits, and rescheduling options apply only to the original booking and may not be transferable unless approved by Tanner Underwater.

Weather and Ocean Conditions

All trips are subject to weather, sea conditions, visibility, and the captain’s judgment. Forecasts can change quickly, and rain, clouds, wind, or imperfect visibility do not automatically result in cancellation.

The captain has final authority to delay, modify, shorten, reroute, reschedule, or cancel a trip when conditions are considered unsafe or unsuitable.

If Tanner Underwater cancels a trip before departure, guests will be offered the option to reschedule or receive a refund for the canceled activity.

Tanner Underwater is not responsible for related expenses, including airfare, lodging, transportation, meals, or other travel costs. Travel insurance is strongly recommended.

Wildlife Encounters

All wildlife is wild and free-ranging. The presence, number, species, proximity, and behavior of sharks or other marine animals cannot be predicted or guaranteed.

A lack of sightings or a guest’s dissatisfaction with wildlife activity does not qualify the trip for a refund, credit, or complimentary return trip.

Seasickness, Illness, and Guest Comfort

Ocean travel may cause seasickness, motion sickness, nausea, vomiting, dizziness, fatigue, anxiety, or discomfort. These conditions do not qualify a guest for a refund or credit.

Guests are responsible for preparing appropriately and consulting a qualified medical professional regarding seasickness medication or other health concerns. Tanner Underwater and its crew cannot provide medical advice or medication recommendations.

If a guest becomes ill or chooses to stop participating, the captain is not required to end the trip early or return to shore unless the captain determines that doing so is necessary.

Arrival and Departure

Guests must arrive at the stated meeting location by the check-in time provided in their confirmation.

Guests arriving more than 15 minutes late may be treated as no-shows. The vessel may depart without late guests, and no refund or credit will be provided.

Tanner Underwater is not responsible for missed departures caused by traffic, parking, flight disruptions, incorrect directions, or other transportation delays.

Participant Conduct

Guests must follow all instructions provided by the captain and crew. Tanner Underwater may refuse boarding or remove a guest from an activity when the guest:

  • Appears impaired by alcohol, illegal drugs, or another substance

  • Behaves recklessly, abusively, or disruptively

  • Refuses to follow safety instructions

  • Creates a risk to themselves, another guest, the crew, wildlife, or equipment

A guest refused participation or removed for any of these reasons will not receive a refund.

Personal Belongings

Guests are responsible for their personal property, including cameras, phones, jewelry, clothing, and other equipment.

Tanner Underwater is not responsible for belongings that are lost, stolen, damaged, dropped overboard, or exposed to water.

Guests should bring only items suitable for use aboard a vessel and protect electronics in an appropriate waterproof case or dry bag.

Photo and Video Packages

Photo and video packages are nonrefundable after the trip has taken place.

Ocean conditions, visibility, wildlife behavior, equipment performance, and participant positioning are unpredictable. Tanner Underwater cannot guarantee a particular image, encounter, quantity of footage, or creative result.

Delivery times are estimates and may vary depending on file volume, editing requirements, and technical circumstances.

Photography, Video, and Guest Likeness

Photography, video, audio, and drone footage may be captured during a trip.

Unless otherwise agreed in writing before departure, guests authorize Tanner Underwater and its production partners to photograph and record their participation. This material may be used for advertising, social media, educational content, television, streaming, documentary productions, and other promotional or commercial purposes without additional compensation.

Guests who do not wish to appear in promotional media must notify Tanner Underwater in writing before the trip. Tanner Underwater will make reasonable efforts to honor the request but cannot guarantee exclusion from incidental background footage.

Schedule and Vessel Changes

Tanner Underwater may substitute a vessel, captain, crew member, guide, departure point, or schedule when reasonably necessary because of weather, maintenance, operational requirements, or circumstances beyond its control.

Any substitute arrangement will be intended to provide a reasonably comparable experience but does not guarantee identical equipment, timing, or conditions.

Complaints and Service Concerns

Any concern should be reported to the captain or crew as soon as possible so there is an opportunity to address it during the trip.

Formal complaints must be submitted in writing within 48 hours after the trip. The submission should include the guest’s name, booking date, reservation number, and a clear description of the concern.

Governing Law and Venue

These Terms & Conditions are governed by applicable federal maritime and admiralty law. Where federal maritime law does not apply, the laws of the State of Florida will govern.

To the extent permitted by law, any dispute relating to a booking or charter must be brought in the appropriate court located in Florida.

Separate Liability Waiver

These Terms & Conditions address booking and operational policies. They do not replace the separate Assumption of Risk and Release of Liability required of every guest.

Participation is prohibited unless all required documents have been completed and accepted before departure.

Acceptance of Terms

By completing a reservation, the booking guest acknowledges that they have read, understood, and accepted these Terms & Conditions.

The booking guest also agrees to communicate these policies to every person included in the reservation.
